Clause regarding restriction on right to travel suggested to come into force from 2021

 Ulaanbaatar /MONTSAME/ The Parliamentary Standing Committee on Legal Affairs discussed and supported the  Amendment Bill to the Criminal Procedure Code. According to the article 5 of the Criminal Procedure Code, a clause about the restriction on the civilian right to freedom of movement should have come into force from January of this year, however the draft amendment to the law suggests to postpone it till 2021. Minister of Justice and Interior Affairs Ts.Nyamdorj said: "It is planned to use electronic surveillance devices when restricting the right to travel. According to this, it was decided to establish the "Electronic Control and Management Center" with a soft loan of USD 9.5 million from the Korean Exim Bank, and the feasibility study was developed. However, South Korean side proposed to increase the budget for establishment of the center to USD16.1 million.  In response, we presented our proposal to raise the budget maximum of USD10.4 million. This issue has not yet been resolved and the types of electronic wristbands and their specifications and other devices for the purpose of enforcing the restriction sentence are still not clear.” Therefore, the bill reflects that commencement of article 5 of the Criminal Procedure Code to be January 1, 2021. Members of the Standing Committee supported to discuss the bill further.
