Resolution on limitation of period to allow re-investigation of corruption cases

Ulaanbaatar /MONTSAME/. Parliament, at its session of January 10, backed a bill on resolution to follow the amendments to the Criminal law. 


The newly approved resolution changes the regulation on the statute of limitation period of crimes with a view to prevent from uncertainty of counting the date of limitation period of cases under investigation or court proceedings as well as out of the necessity to re-investigate corruption cases, in which culprits who have committed the crimes are no longer subjected to criminal liability on elapse of statute of limitation period. 


There are 4 cases in 2018 and 9 cases in 2019 recorded to be dismissed during investigation process due to the lapse of the limitation period, since July 1, 2017 when the Criminal law took effect. 


Head of Parliamentary Standing Committee on Justice Kh.Nyambaatar explained that the bill is directed at inquiring into some unresolved cases, quoting the Article 29 of the United Nations Convention Against Corruption “Each State Party shall, where appropriate, establish under its domestic law a long statute of limitations period in which to commence proceedings for any offence established in accordance with this Convention and establish a longer statute of limitations period or provide for the suspension of the statute of limitations where the alleged offender has evaded the administration of justice.”
