Ulaanbaatar /MONTSAME/ The Cabinet decided to submit draft revised law on Labor to the parliament after discussing the draft during its meeting on September 20.

The draft law addressed some pressing issues pertaining to labor relation. The existing Labor law regulates labor relation since the conclusion of labor contract, narrowing the scope of the law and there are many cases that employer hires employee without establishing labor contract and the employee cannot enjoy his/her rights and suffers a loss. Therefore, labor relation is to be considered as established from time when nature of the employment relationship is created, specified the draft law.

Moreover the draft law identified employee’s basic rights in labor relations and duties undertake before employer in detail. The draft targeted to create possibility to resolve labor dispute at primary level, and to shorten resolving period of labor dispute as well as to make structure of labor dispute settlement  organization appropriate.

Employer and employee will have possibility to negotiate on labor condition. Revising the Labor law it aimed also to set remuneration in conformation with employee’s skill, performance and professional grade, encouraging employee to professionalize and improve skill and efficiency. In addition, the draft law requires employer to specifically regulate employee’s working and rest hours, who works in mining sector, away from his/her home permanently.
